In these Terms, “Aruna Med,” “Aruna,” “we,” “us,” and “our” refer to Aruna Naturopathic PC., DBA Aruna Med. Clinical services may also be provided under the name Aruna Personalized Medicine.
By accessing this website, creating an account, registering for an event, purchasing a product or service, or otherwise using our services, you agree to these Terms.
If you do not agree with these Terms, please do not use the website or purchase our products or services.
1. Eligibility
Our paid courses, webinars, coaching programs, digital products, and other services are intended for adults age 18 and older.
By purchasing or registering for these services, you confirm that you are at least 18 years old and have the legal capacity to enter into an agreement.
2. Educational Services Are Different From Medical Care
Dr. Manna Semby is a California-licensed naturopathic doctor. She also provides educational programs, webinars, courses, health coaching and other services that are not medical care.
Purchasing or participating in a webinar, course, coaching service, educational program, digital resource or other non-clinical offering does not establish a doctor-patient relationship with Dr. Manna Semby or Aruna Personalized Medicine.
Educational and health coaching services are intended to provide general education, information, strategies and support. They do not include medical diagnosis, medical treatment, prescribing or individualized medical care.
Information provided through our website, emails, videos, webinars, courses, downloads, social media, health coaching or other educational materials is not a substitute for individualized advice from your own licensed healthcare professionals.
You should consult an appropriately licensed healthcare provider regarding medical symptoms, diagnoses, medications, supplements, laboratory results, treatment decisions or other personal health concerns.
3. Naturopathic Medical Care
Dr. Manna Semby provides naturopathic medical services pursuant to her professional licensure and applicable law.
A doctor-patient relationship is established only when you have been formally accepted as a patient and have completed the applicable intake, consent and patient agreement process.
Clinical services are governed by separate patient agreements, informed-consent documents, financial policies, privacy notices and other applicable clinical documents.
Those agreements may contain terms concerning:
- scope of medical care;
- telemedicine;
- payment plans;
- refunds;
- cancellation and missed appointments;
- laboratory testing;
- communications;
- patient responsibilities;
- privacy and medical records; and
- dispute resolution.
If these general website Terms conflict with a signed patient agreement concerning clinical services, the patient agreement controls with respect to those clinical services.
Dr. Manna’s medical practice is not a substitute for primary care and does not provide emergency or urgent care services.
4. Health Coaching
Health coaching is separate from naturopathic medical care.
Health coaching may be offered to individuals who are not receiving medical care from Dr. Manna, including individuals located outside California where appropriate.
Health coaching may include education, goal setting, lifestyle strategies, accountability, behavior-change support and general wellness information.
Health coaching does not include medical diagnosis, prescribing, treatment of disease or other services requiring a medical provider-patient relationship.
Individual or group coaching programs may require a separate coaching agreement. When a separate coaching agreement applies, that agreement will govern the coaching relationship in addition to these Terms. If there is a conflict, the more specific coaching agreement will control.
5. Not for Emergencies
The website, email, text messaging, courses, webinars, coaching programs and other educational services are not intended for urgent or emergency medical situations.
If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency medical care.
Established patients should follow the communication and emergency procedures contained in their patient agreements.
6. Purchases and Payment
Prices and payment terms are displayed at the time of purchase.
By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us and our payment processor to charge the applicable amount.
We may use third-party payment processors such as Stripe or other providers. Your payment information may therefore be subject to the privacy policies and terms of those providers.
Unless specifically stated otherwise at the time of purchase, our educational products and programs do not automatically renew.
If an offering includes an installment payment plan, agreeing to the plan is a commitment to make the remaining payments according to the terms presented at purchase. An installment plan is not a month-to-month subscription unless we specifically describe it that way.
7. Refunds and All-Sales-Final Policy
Courses and Digital Products
All sales of courses, recorded programs, downloadable materials and digital products are final and non-refundable unless the applicable sales page expressly states otherwise.
Because access to digital materials may be provided immediately after purchase, refunds are not available simply because you did not use, complete or access the materials.
Live Webinars, Masterclasses, Workshops and Events
Registration fees for paid webinars, masterclasses, workshops and similar educational events are non-refundable unless the specific sales page expressly states otherwise.
If you do not attend a live event, you are not entitled to a refund.
A replay may be provided when stated in the event description, but purchasing a live event does not automatically guarantee that a replay will be available.
Coaching
Refunds, cancellations and rescheduling for individual or group coaching are governed by the applicable coaching agreement.
Clinical Programs
Refund, cancellation, payment and program policies for naturopathic medical services are governed by the applicable patient agreement and clinical financial policies.
8. Access Periods and Replay Availability
Access periods vary among webinars, courses, programs and other offerings.
The sales or registration page for each offering will state the applicable access period when relevant.
Purchase does not imply lifetime access.
A replay or online program may be available for a limited period, and access may expire at the end of the period stated when you registered or purchased.
You are responsible for reviewing the access period associated with an offering.
We may make reasonable technical or platform changes to how content is delivered as long as those changes do not materially eliminate access that we expressly promised for a defined period.
9. One Purchase Is for One Person
Unless we expressly state otherwise, each purchase provides access for one individual only.
Your purchase gives you a limited, personal, non-exclusive, non-transferable license to access the materials for your own personal use.
You may not:
- share your account or login credentials;
- give another person access to a paid program;
- share paid videos, recordings or replays;
- distribute PDFs, workbooks, slides, transcripts or course materials;
- copy or reproduce substantial portions of our materials;
- upload our materials to another website, course platform, file-sharing service or artificial intelligence training dataset;
- resell, sublicense or commercially exploit our materials;
- create or sell derivative educational products substantially based upon our proprietary materials; or
- record paid presentations or course sessions without our written permission.
Organizations seeking access for multiple people should contact us about group or organizational licensing.
10. Intellectual Property
Unless otherwise indicated, the content available through the Aruna Med website and our educational programs—including text, videos, graphics, presentations, course materials, downloads, worksheets, frameworks, recordings, logos and other original materials—is owned by or licensed to Aruna Med and is protected by applicable intellectual-property laws.
Your purchase of a course, event or product gives you permission to use the materials personally. It does not transfer ownership or intellectual-property rights to you.
You may quote brief portions of publicly available materials for legitimate commentary or other uses permitted by law, provided appropriate attribution is given.
Nothing in these Terms is intended to restrict rights that applicable copyright or other law expressly provides to you.
11. Live Events, Group Programs and Recordings
Some webinars, workshops, courses, coaching programs and other events may be recorded.
If an event is being recorded, we will make reasonable efforts to inform participants.
If you choose to speak, ask a question, appear on camera, participate in discussion or otherwise contribute during a recorded session, your voice, image, displayed name or comments may be captured in the recording.
Recordings may be made available as event replays or as part of the associated educational program.
We make reasonable efforts to protect participant privacy, but privacy cannot be guaranteed in a live or recorded group event.
Do not disclose medical information, protected health information, financial information or other sensitive personal information during a group session unless you are comfortable with other participants potentially hearing or seeing that information.
Participants are expected to respect the privacy of others and may not independently record, reproduce or distribute group sessions.
Participation in a group program does not create confidentiality obligations between participants comparable to those that may apply between a healthcare professional and a patient.
If we wish to use an identifiable participant’s image, statement or story separately as a testimonial or advertisement, we may request additional permission where appropriate.
12. Results Are Not Guaranteed
Health, wellness, educational and coaching outcomes vary substantially from person to person.
We do not guarantee that participation in any course, webinar, coaching program, clinical program or other offering will result in a specific medical, cognitive, personal, professional or financial outcome.
Testimonials, case studies, examples and participant stories describe individual experiences and should not be interpreted as a promise that another person will obtain the same result.
Educational information may discuss scientific research, clinical experience and emerging approaches to health. Medical knowledge changes over time, and no educational material can account for every individual’s circumstances.
13. Information on the Website
We make reasonable efforts to provide accurate and useful information. However, website and educational content is provided for general informational and educational purposes.
Information may become outdated as research, clinical guidance, technology, products, regulations or other circumstances change.
We do not warrant that every piece of information on the website will always be complete, current or error-free.
We reserve the right to correct, update or remove content at any time.
14. Supplements, Laboratories and Third-Party Products or Services
We may discuss, recommend or provide links to third-party products and services, which may include laboratory companies, supplement providers, books, technology services or other resources.
We do not control third-party businesses and are not responsible for their websites, products, pricing, availability, privacy practices or performance.
Dr. Manna or Aruna Med may in some circumstances receive a commission, referral fee, professional discount or other financial benefit associated with a product or service that is recommended or linked. Where required or appropriate, we will disclose such relationships.
You are not required to purchase supplements or other third-party products through a particular provider merely because we recommend or link to that provider.
Clinical patients should follow the specific recommendations and disclosures contained in their patient agreements and treatment plans.
15. Email Communications
When you request information, register for an event, make a purchase, subscribe to our mailing list or otherwise consent to communications, we may send you email related to your request, registration, purchase or relationship with us.
Where you have consented to marketing communications, we may also send educational content, news, announcements, event information and promotional offers.
You may unsubscribe from marketing email at any time using the unsubscribe link included in our marketing messages.
Certain transactional or service-related communications may still be necessary to fulfill a purchase or administer a service you requested.
16. SMS/Text Messaging Terms
Aruna Personalized Medicine Text Messaging Program
By opting in to receive text messages from Aruna Personalized Medicine, you consent to receive recurring SMS messages at the mobile number you provide.
Messages may include event and webinar reminders, educational information, requested resources, practice and service updates, appointment-related communications, and information about programs or services offered by Aruna Personalized Medicine.
Message Frequency
Message frequency varies depending on the programs, events, services, or communications for which you have registered or provided consent.
Charges
Message and data rates may apply according to your mobile carrier and service plan.
Opting Out
You may unsubscribe from text messages at any time by replying STOP to any message.
After you opt out, you may receive one final message confirming that your unsubscribe request has been processed. We will not send additional messages covered by that consent unless you later opt in again.
Help
For assistance, reply HELP to any text message, email moc.demanura@olleh, or call (760) 585-9393.
Consent
Consent to receive marketing text messages is not a condition of purchasing any product or service.
Providing your telephone number alone does not necessarily constitute consent to receive promotional or marketing text messages. Where consent is required, it will be requested separately at the applicable opt-in point.
Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
Privacy
Your privacy is important to us. Mobile phone numbers and SMS opt-in information or consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes.
We may share information with service providers that process text communications on our behalf as necessary to provide the messaging service.
Please review our Privacy Policy for additional information about how we collect, use, and protect personal information.
Medical Information by Text
Ordinary SMS is not intended for transmitting private medical information or detailed health questions.
Established patients should use the secure patient communication methods specified by Aruna Personalized Medicine for health-related communications.
17. Acceptable Use
You agree not to use this website or our services to:
- violate applicable law;
- interfere with the operation or security of the website;
- attempt to gain unauthorized access to accounts or systems;
- impersonate another person;
- scrape, systematically download or harvest protected content;
- upload malware or malicious code;
- infringe intellectual-property or privacy rights;
- harass other participants or staff;
- distribute recordings or confidential group-program information without authorization; or
- use our content or services for fraudulent or unlawful purposes.
We may suspend or terminate access to a program or service if a user materially violates these Terms or disrupts the experience, privacy or safety of others.
Termination for violation of these Terms does not automatically entitle the user to a refund.
18. Accounts and Security
If an offering requires an online account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
Please notify us promptly if you believe your account has been accessed without authorization.
We are not responsible for losses caused by your voluntary sharing of account credentials or your failure to take reasonable steps to secure your account.
19. Third-Party Websites and Platforms
Our website and programs may use or link to third-party services such as video conferencing platforms, course platforms, payment processors, scheduling tools, laboratories, supplement dispensaries, email providers and other online services.
Your use of those services may also be governed by their own terms and privacy policies.
A link or reference to a third-party resource does not necessarily constitute an endorsement or guarantee of that third party.
20. Technology and Availability
Online services depend on technology that is not always within our control.
We cannot guarantee uninterrupted access to websites, video platforms, course systems, email, text messaging, livestreams, videoconferencing or other technology.
Temporary outages, maintenance, software failures, internet disruptions or third-party service interruptions may occur.
When a material technical problem substantially interferes with a paid event or service, we will make reasonable efforts to provide an appropriate alternative, replacement access or other remedy based on the circumstances.
21. Limitation of Liability
To the fullest extent permitted by applicable law, Aruna Med and its owners, employees, contractors and representatives will not be liable for indirect, incidental, special, punitive or consequential damages arising from the use of our website or non-clinical educational products and services.
For claims arising from a purchased non-clinical product or service, our aggregate liability will not exceed the amount you paid us for the specific product or service giving rise to the claim, except where applicable law does not permit such a limitation.
Nothing in these Terms is intended to waive or limit rights or liabilities that cannot legally be waived or limited.
Claims arising from clinical medical services may be governed by separate patient agreements and applicable healthcare law.
22. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims or expenses reasonably incurred by Aruna Med as a result of your unlawful use of our services, infringement of another person’s rights, unauthorized distribution of our protected materials, or material violation of these Terms.
This provision does not require you to indemnify us for our own unlawful conduct.
23. Governing Law
These Terms and disputes arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
24. Dispute Resolution and Arbitration
We hope to resolve disagreements directly whenever possible.
Before initiating arbitration concerning these Terms or our non-clinical products or services, you agree to contact us and make a good-faith attempt to resolve the dispute informally.
If a dispute cannot be resolved informally, either party may submit the dispute to binding arbitration before a single arbitrator in San Diego County, California, administered under the applicable consumer rules of the American Arbitration Association unless the parties mutually agree to another process.
The arbitrator, rather than a court or jury, will resolve the dispute and may award any remedy available under applicable law.
Either party may bring an individual claim that qualifies for small claims court rather than arbitration.
To the extent permitted by applicable law, disputes will be resolved on an individual basis rather than as a class, collective or representative action.
By agreeing to binding arbitration, both parties understand that they are generally waiving the right to have covered disputes decided by a judge or jury.
This section applies to disputes arising from these Terms and our non-clinical offerings. Clinical services may be subject to separate dispute-resolution and arbitration provisions contained in applicable patient agreements and required by healthcare law.
Nothing in this section prevents either party from seeking emergency or temporary injunctive relief from a court when necessary to prevent misuse of intellectual property, unauthorized disclosure of confidential information or similar immediate harm.
25. Changes to Services
We may modify, improve, replace or discontinue website features, educational offerings or future services.
If you have purchased access to a product for a specifically stated period, we will make reasonable efforts to honor that access commitment or provide a reasonably equivalent remedy if circumstances outside our control make the original form of access impossible.
The fact that a program, service or website remains available at the time of purchase should not be interpreted as a promise that it will remain available indefinitely.
26. Changes to These Terms
We may update these Terms from time to time as our services, business practices or legal obligations change.
The current version will be posted on this website with its effective or updated date.
Changes will apply prospectively from the date they become effective unless applicable law requires otherwise.
Your continued use of the website or services after revised Terms become effective constitutes acceptance of those revised Terms where legally permitted.
27. Severability
If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
28. Entire Agreement
These Terms, together with any applicable sales page, checkout terms, coaching agreement, patient agreement or other specific agreement between you and Aruna Med, constitute the applicable agreement concerning the service you are using.
When a specific written agreement applies to a particular service and conflicts with these general Terms, the more specific agreement controls for that service.
